Negligence is just one of the three components of a successful medical malpractice case. Causation also has to be a factor, which means the injuries must have been caused by a breach of standard of care. This can be a tricky issue because generally the patient was sick to begin with.
The third thing is that the damages have to be significant enough. What is considered significant varies among lawyers and the details of the case. For example, if a lot of experts are needed, then damages will need to be high.
