We were operating under a legal regime dating back to the nineteenth century that prohibited wrongful death claims for children and elderly people. The reason was that you could only file a claim if it was a ‘breadwinner” type claim. It was believed that there were no damages or pain and suffering concerning the wrongful death of an elderly person or a young person.

Fortunately, that changed in the wake of the Breast Cancer Testing Class Action. The government realized that this type of legal regime was extremely unjust, unfair and was based on outdated law.

Since then, the Fatal Accidents Act has been amended to allow family members to file a wrongful death claim.
