Advanced Medical Optics
On July 26, 2007, Ches Crosbie Barristers commenced a class action on behalf of Newfoundland and Labrador residents against Advanced Medical Optics, the makers of a contact lens solution with a Canadian drug identification number. In May 2007, AMO announced a global recall, and then an urgent Canadian recall, of their contact lens solution. On May 30, 2007, Health Canada issued a public health advisory concerning the recall.The cause of the recall was a connection between the contact lens solution and a significant increased risk for contact lens wearers of developing Acanthamoeba keratitis ("AK"). AK is an extremely painful and debilitating eye infection which can result in blindness. It is caused by a protozoa which can invade and attack the cornea if introduced into the eye. It is treatable if caught early enough, but may result in complications which require corneal transplant.
The background incidence for this infection has been estimated at only one or two cases per million individuals per year. The incidence of infection for consumers of the contact lens solution made by Advanced Medical Optics is seven times as high.

Any person who has used contact lens solution manufactured and supplied by AMO Canada Company and Advanced Medical Optics, Inc., sold as CompleteTM All-In-One Moisture PlusĀ® contact lens solution (Drug Identification Number 02034425), and has suffered unusual eye symptoms, may be eligible to join this class action. Symptoms of AK include eye pain, redness, blurred vision, light sensitivity, tearing, and the sensation of something being in the eye. In early stages, AK may be confused with less serious eye conditions. Any sufferer of these symptoms who is not already under the care of a health care professional, should contact their health care professional at once.
In the recall announcement, AMO told consumers to stop using the Complete contact lens solution immediately, and to discard lenses and containers used with Complete. DO NOT THROW THE LENSES AND CONTAINERS AWAY! The lenses and containers may serve as valuable evidence should you wish to make a claim.

We have recommended to our class members that it would be in their interest to opt into the British Columbia class action against AMO, taken by the Vancouver firm Klein Lyons. Representative plaintiff Travis Harris of St. John's, has agreed with this recommendation, on the basis that it is likely to save costs for all parties and that the BC class action is farther advanced towards certification and settlement. We continue to assist clients in Newfoundland and Labrador to obtain their rightful compensation by means of the BC class action.
The Supreme Court of British Columbia certified the AMO class action as a national class action by decision handed down on May 26, 2009.
