Q: You declined my malpractice case.  How come?

A: We are in this business to make a reasonable profit for the work that we do.  Each year we review approximately 300 new medical malpractice cases.  We are honored that so many people look to us for legal advice.  Because we are a small firm, however, we can only accept a small number of cases.  Many of the cases are legitimate cases of injury caused by a doctor or other health care provider.  These cases, however, are very expensive to prosecute and require hundreds of hours of attorney time.  If these cases settle at all it is usually just before trial.  Since we do not get paid a legal fee unless we win we must be very selective in deciding which cases we will handle.  There are some meritorious cases that we won’t handle simple because the damages are not large.  After all, it does you no good to “win” your case only to have the total recovery eaten up by legal fees and expenses.  Other cases, in our judgment, are simply not winnable.  Again, it does you no good to go through years of litigation and expenses only to have the Court return a verdict for the doctor.
