The general rule in Newfoundland and Labrador is "loser pays" - if you go to court and lose the judge will order costs against you as a matter of course. The amount of costs will vary with the circumstances, including the length of the trial, but can easily be thousands of dollars. The costs factor is something which you and your lawyer should review from time to time as your case develops and more information becomes available on which to assess your prospects for success. The object of any claim for damages for personal or bodily injury, whether through slip and fall, motor vehicle accident, medical malpractice, wrongful death, or any other type of accident, is to obtain a reasonable settlement without going to court.
