What is the limitation period (and do I still have a case)?

 

A: Generally speaking, you must take action wtihin two years of the accident in a personal injury case.  This rule is full of exceptions.  If the claimant is under 19, or has a mental incapacity, the limitation may be much longer.  If the wrong is not obvious, the limitation may be much longer.  If the wrong was concealed by the defendant, the limitation may be much longer.  Lots of circumstances can influence the limitation period.  It costs nothing to ask one of our knowledgeable lawyers before you decide whether you still have a case.
