I received a personal injury claim award, prior to my separation, and used the money to purchase a new vehicle. Is my new vehicle subject to division even through it was purchased with excluded "non-economic loss" awarded funds?
A:
Once funds, which were otherwise excluded from division, are used to purchase something that would normally be considered a matrimonial asset, the excluded funds lose their identity in the matrimonial asset. In this situation the newly purchased vehicle would be subject to division in accordance to the Family Law Act.
