Does a bad outcome mean that medical malpractice has occurred?
A: No. In medicine bad things can happen. A patient can die in the OR or suffer adverse side effects without anyone being at fault. Even when doctors do their job perfectly people can still suffer. Medical malpractice only occurs when a doctor has been negligent.
