I was walking on the road because the sidewalk was full of snow and ice, and a car hit me. Can I sue?

If you live in Newfoundland and Labrador, then you know that sidewalks are often impassable to pedestrians, who have no choice but to walk on the roadway.  This may be true of St. John’s more than anywhere.

Motorists know that pedestrians often must walk on the roadway. Therefore they have to be vigilant and share the road in a careful manner. Motorists can be sued for injury compensation if they are not careful and reasonable in sharing the roadways with others.

Pedestrians are wise to walk facing traffic and to keep as close as practicable to the side of the road.
