The Cost Of Not Wearing A Seatbelt

Two workers leaving shift at Long Harbour went off the Long Harbour Access Road in the early hours of April 29, 2015.

Both people were ejected from the pick-up truck, and the RCMP have rightly stressed the importance of seatbelt use.

Both are reported to be in hospital, one in critical and the other in serious condition.

Seatbelt use may have avoided the injuries which sent the driver and his passenger to hospital. The passenger may have a valid claim against the driver for his injuries, but under legislation passed in 2004, the question of whether seatbelt use would have avoided or lessened injury is irrelevant to any accident claim. An automatic 25% reduction on the amount of the claim is imposed by law. Serious injury may leave the passenger little option but to make a claim nonetheless.
